Terms of Use

These terms of use govern the rules for using the Záchyt app (the "App"), which may be available as a mobile application and/or web service.

By using the App you express your agreement with these terms. If you do not agree with them, please do not use the App.

The Záchyt app is an informational and navigational tool that helps users orient themselves in preventive screening programs and related prevention options in the Czech Republic.

In particular, the App may:

• Display information about screening programs based on publicly available rules
• Personalize the overview based on data you enter into the App
• Allow you to record completed examinations and approximate dates
• Help find suitable providers
• Offer an informational family history questionnaire and navigational signals

The App:

• Does not provide diagnosis
• Does not determine individual health risk
• Does not replace medical decisions, examinations or professional consultation
• Is not a medical recommendation

Information displayed in the App is based primarily on publicly available rules of screening programs, information from health insurance companies, and other public sources. This information may be simplified, incomplete, or not up to date at a given time.

Outputs of the family history questionnaire or similar features are purely informational and navigational. They are neither a diagnosis nor a recommendation for genetic or other examination.

Always follow the instructions of your treating physician. In case of acute health problems, contact a doctor or emergency medical services.

The App can be used without registration. By default, profile and prevention data remain only on your device.

If you voluntarily enable cloud synchronization or other sign-in, you may be asked to provide an e-mail address or other technical data necessary for verification and synchronization.

Cloud synchronization may have several levels. Basic synchronization is used to use selected data across multiple devices. Some more sensitive data, especially data from family history and related evaluations, is synchronized only if you separately and explicitly enable it in the App.

You are responsible for keeping the data you enter into the App reasonably current and accurate, as the customization of content and some indicative calculations may depend on it.

The App may work with data from public sources, for example from the Ministry of Health of the Czech Republic, ÚZIS, health insurers or other publicly available sources that we try to keep updated.

The Operator strives for correctness and currency of the information displayed, but cannot guarantee its completeness, accuracy, error-free nature or continuous timeliness.

The App may contain simplifications necessary for clarity, usability or technical processing.

Information in the App serves only as an informational and navigational aid. The Operator is not responsible for decisions made solely on the basis of information from the App.

The App, its design, software, texts, database structure and other related elements may be protected by copyright and other intellectual property rights of the Operator or third parties.

The user is entitled to use the App only for their own personal and non-commercial purposes, unless explicitly stated otherwise.

Without the prior consent of the Operator, it is not permitted to copy, systematically extract, distribute, make available to third parties or commercially exploit the content of the App.

The App is provided "as is", to the extent permitted by law.

The Operator does not guarantee that the App will always be available without interruption, without errors or that it will be suitable for a particular individual purpose.

To the maximum extent permitted by law, the Operator is not liable in particular for:

• Damages arising from the use or impossibility of using the App
• Decisions made on the basis of information from the App
• Loss or damage of data on the user's device
• Temporary unavailability of the service
• Incompleteness, inaccuracy or outdatedness of data taken from public or external sources

This does not affect the user's rights that cannot be excluded or limited under applicable law.

The user must not, in particular:

• Use the App in a way that could endanger its operation, security or availability
• Attempt unauthorized access to servers, accounts or data of other users
• Automatically download, extract or scrape the content of the App without the Operator's consent
• Circumvent the App's technical or security measures
• Present information from the App as a medical recommendation, diagnosis or professional medical conclusion
• Use the App in violation of applicable laws

The Operator reserves the right to modify or supplement these terms from time to time.

The current version will always be available in the App or on the related website. In case of a material change, we will try to notify you in a reasonable manner.

By continuing to use the App after the amended terms take effect, you express your agreement with their current wording.

These terms are governed by the law of the Czech Republic.

Any disputes arising in connection with the use of the App shall be resolved by the competent courts of the Czech Republic, unless mandatory legal provisions provide otherwise.
